1. Acceptance of Terms

By downloading, installing, or using CoachingMate: Tuition Manager ("CoachingMate," "the App," "we," "our," or "us"), you ("User," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not download, install, or use the App.

These Terms constitute a legally binding agreement between you and CoachingMate. Your continued use of the App signifies your acceptance of these Terms and any updates or modifications thereto.

2. Free Service

CoachingMate is provided as a completely free application. There are no subscription plans, premium tiers, in-app purchases, or hidden charges of any kind.

The App is financially supported through advertisements displayed within the application. By using CoachingMate, you acknowledge and agree that advertisements will be displayed during your use of the App.

We reserve the right to modify the advertising model in the future, but we are committed to keeping the core functionality of CoachingMate free for all users.

3. No Warranty

CoachingMate is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of any information or content
• Uninterrupted or error-free operation

We do not warrant that the App will meet your specific requirements, that the App will be uninterrupted, timely, secure, or error-free, or that any defects in the App will be corrected.

4. User Responsibility

As a user of CoachingMate, you are solely responsible for:

• Data backups: Regularly backing up your device data to prevent data loss. Since all data is stored locally on your device, we cannot recover lost data.
• Data accuracy: Ensuring the accuracy, completeness, and appropriateness of all data entered into the App, including student information, attendance records, fee records, and exam results.
• Device security: Maintaining adequate security measures on your device, including lock screen protection, software updates, and protection against unauthorized access.
• Compliance: Complying with all applicable local, state, and national laws and regulations regarding data collection, storage, and use of personal information of students and their families.
• Consent: Obtaining any necessary consent from students, parents, or guardians before recording their personal information in the App.

5. Limitation of Liability

To the maximum extent permitted by applicable law, CoachingMate and its developers, owners, affiliates, and agents shall not be liable for any of the following, whether arising from contract, tort, negligence, strict liability, or otherwise:

• Data loss: Any loss, corruption, or deletion of data stored within the App, whether caused by device malfunction, software updates, user error, or any other reason
• Device issues: Any damage to, or malfunction of, the user's device arising from the installation or use of the App
• Indirect damages: Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, business opportunities, or goodwill
• Third-party services: Any issues arising from third-party advertising services, including data collected by ad networks
• Financial disputes: Any financial disputes between educators and students/parents arising from fee records maintained in the App

6. Advertisements & Third-Party Services

CoachingMate may display advertisements provided by third-party advertising networks. By using the App, you acknowledge and agree to the following:

• Advertisements may be displayed during your use of the App
• Third-party ad networks may collect certain anonymized data as described in our Privacy Policy
• We are not responsible for the content, accuracy, or availability of any advertisements or linked third-party websites
• Your interaction with any advertiser or third-party service is solely between you and that third party
• Third-party privacy policies and terms of service apply to data collected by their services

7. Intellectual Property

All intellectual property rights in CoachingMate, including but not limited to the following, are owned by or licensed to CoachingMate and are protected by applicable intellectual property laws:

• The CoachingMate name, logo, and branding
• App design, user interface, and user experience
• Source code, algorithms, and software architecture
• Documentation, website content, and marketing materials
• Icons, graphics, and visual elements

You may not copy, modify, distribute, sell, lease, or create derivative works based on CoachingMate or any of its content without prior written permission.

8. Termination

You may terminate your use of CoachingMate at any time by uninstalling the App from your device. Upon uninstallation, all locally stored data will be permanently deleted from your device.

We reserve the right to discontinue, suspend, or modify the App at any time without prior notice. We shall not be liable to you or any third party for any discontinuation or modification of the App.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
